15.05.04.J1 High Risk Global Engagement and High Risk International Collaborations

Rule Summary

Employees at Texas A&M University-Victoria (TAMUV) are encouraged to form international partnerships in the search for opportunities mutually beneficial basic scientific research, cultural exchange, or education. These initiatives support research and academic programs. This rule is required by The Texas A&M University System (System) Regulation 15.05.04, High Risk Global Engagements and High Risk International Collaborations.

Definitions

Definitions are consistent with System Regulation, 15.05.04, High Risk Global Engagements and High Risk International Collaborations.

Rule

1. DESIGNATED OFFICIAL

The TAMUV empowered official (EO) pursuant to TAMUV Rule 15.02.99.J1, serves as the designated official for High Risk Global Engagements and High Risk International Collaborations.

2. GENERAL

2.1 Employees are prohibited from engaging in Malign Foreign Talent Recruitment Programs and are required to report any attempts to solicit their participation to the EO. Furthermore, TAMUV will inform the System Research Security officer (RSO) about these solicitations.

2.2 TAMUV is prohibited from maintaining contracts or agreements with Confucius Institutes.

2.3 Employees are prohibited from accepting gifts from a Country of Concern for professional purposes. Any activities in which groups representing a Country of Concern approach employees with gifts or travel offers must be reported to the TAMUV EO, who will then report to the System RSO.

2.4 TAMUV employees are prohibited from entering High Risk Global Engagements and from participating in High Risk International Collaborations with entities on the most recent lists developed pursuant to Section 1286 of the National Defense Authorization Act for Fiscal Year 2019 (Public Law 115-232, as amended).

2.5 Travel to Countries of Concern

All professional travel to a Country of Concern must be reviewed through the System Regulation 15.05.04 process. All employees must report personal travel to Countries of Concern in Workday.

2.6 If TAMUV wishes to accept a gift, whether directly or indirectly from a citizen of a foreign adversary, TAMU V will request approval through the System Regulation 15.05.04 process.

3. HIGH RISK GLOBAL ENGAGEMENT AND HIGH RISK INTERNATIONAL COLLABORATION ADMINISTRATION

3.1 All international engagements and collaborations must be reviewed by Research and Sponsored Programs before execution.

3.1.1 Before any request for approval through the System Regulation 15.05.04 process, Research and Sponsored Programs will make sure that all personnel proposing the subjected activity have taken TrainTraq Course #2111212 at least once in the past two years.

3.1.2 Research and Sponsored Programs will conduct a comprehensive review, including export controls, conflicts of commitment, and undue foreign influence. The EO will assess the results of the review and decide if the activity should proceed.

3.1.3 Research and Sponsored Programs will then provide approval, unless the international engagement and collaboration involves a Country of Concern. If the proposed activity is a High Risk Global Engagement or High Risk International Collaboration, the EO must approve and submit the request to the System RSO for review and approval. Once a final adjudication is provided pursuant to System Regulation 15.05.04, Research and Sponsored Programs will notify the involved parties. Any defined mitigating measures for approvals will be monitored by Research and Sponsored Programs.

3.1.4 Research and Sponsored Programs may enforce disciplinary actions for TAMUV employees who do not comply with reporting and monitoring activities.

3.2 Maestro is the depository for documents involving High Risk Global Engagement and High Risk International Collaboration and for all record retention.

4. TRAINING

All employees involved in High Risk Global Engagement and High Risk International Collaboration are required to complete “Export Controls and Embargo Training” (course number 2111212) via TrainTraq at least once every two years.
